  • We only issue permits for residents of our fire district.  If you are unsure if you’re in our district or our primary service area, please contact Chief Krebs using the contact information shown on the page.
  • If you are NOT in either, please obtain your permit from https://my.azdeq.gov/open-burn/openburn/landing.  Answer the questions until you’re asked if you’re in one of the specified Fire Jurisdictions.  Answer “NO” to continue the application process through ADEQ.
  • Permits are issued under authority from the Arizona Department of Environmental Quality.
  • THIS IS A LEGALLY BINDING DOCUMENT AND A MATTER OF PUBLIC RECORD.
  • This will be MUCH easier on a smartphone or tablet.
  • DRAW a map showing the location of your burn in relation to structures, utility lines, trees, et cetera, AND the distance to them.  YOU WILL BE REQUIRED TO UPLOAD THE MAP.  Please be sure it’s in JPG or PNG format.
  • CAMP FIRES do NOT require a permit.
  • BON FIRES DO require a permit.
  • Please allow up to 24-48 hours for processing.
  • When your permit is issued, you will find it in your spam folder.  If it’s still not there after 24 hours, please email asst-Permits@stdavidfire.com.
  • UNTREATED LUMBER means NO manufactured, painted, stained, varnished, or water/bugproofed wood!

    Burn Method: PitPileDitchFeildApproved Waste Burner An approved waste burner means an incinerator constructed of fire resistant material with a cover or screen that is closed when in use and has openings in the sides or top no greater than one inch in diameter.
    "BURN BARRELS" ARE NOT ALLOWED. BURNING HOUSEHOLD TRASH IS NOT ALLOWED.

    Distance to Closest Structure: Distance MUST be at least 50 feet. This is randomly checked.

    Permit Conditions

    1. Permits may only be issued to the legal owner of the property. Written, notarized permission is required otherwise.
    2. Permits can only be issued to persons 18 years of age or older. Persons under the age of 18 are NOT allowed to start or monitor controlled burns for any reason. This is a state regulation.
    3. Permittee must call the Benson Police Department at prior to and after burning each day.
    4. Fires can be started no earlier than one hour after sunrise. Burn must beextinguished and completely cold to the touch at least two hours before sunset.
    5. Permittee must stand or sit at fire at all times until it is completely extinguished.
    6. Permittee must have a copy of this permit on-site during open burning.
    7. Permittee must start fire using items that do not cause the production of black smoke.
    8. Permittee can only conduct open burning during atmospheric conditions that:
      • Prevent dispersion of smoke into populated areas
      • Prevent visibility impairments on roads or at airports that result in a safety hazard
      • Do not create a public nuisance or adversely affect public safety
      • Do not cause an adverse impact to visibility in a Class I area
      • Do not cause uncontrollable spreading of the fire
    9. Burning cannot be conducted when an air stagnation advisory has been issued by the National Weather Service for the area.
    10. Burning cannot be conducted when any stage air pollution episode has been declared.
    11. Any public official may order that the burn be extinguished or may prohibit burning during periods of inadequate smoke dispersion, excessive visibility impairment, or extreme fire danger.


    ARS 13-1706. It is unlawful for any person, without lawful authority, to intentionally, knowingly, recklessly or with criminal negligence to set or cause to be set on fire any wild land other than the person’s own or permit a fire that was set or caused to be set by the person to pass from the person’s own grounds to the grounds of another person. A person who violates this section is guilty of a class 1 misdemeanor, class 2 misdemeanor, class 3 felony or class 6 felony.

I further state that I will assume full legal and financial responsibility for conducting open burning in accordance with the Arizona Administrative Code, Title 18, Chapter 2 and any open burning permit issued thereof.
